{"id":4034,"date":"2012-10-25T10:51:50","date_gmt":"2012-10-25T17:51:50","guid":{"rendered":"http:\/\/corbamtb.com\/news\/?p=4034"},"modified":"2012-10-25T10:51:50","modified_gmt":"2012-10-25T17:51:50","slug":"hastain-trail-victory","status":"publish","type":"post","link":"https:\/\/corbamtb.com\/news\/2012\/10\/25\/hastain-trail-victory\/","title":{"rendered":"Hastain Trail Victory"},"content":{"rendered":"<p>Back in <a href=\"http:\/\/corbamtb.com\/news\/2011\/03\/24\/hastain-trail\/\" target=\"_blank\">March 2011<\/a>\u00a0we reported on a developer&#8217;s attempts to cut off the Hastain trail, which has been in public use for more than forty years. A group of local advocates and trail lovers led by Ellen Scott, through the <a href=\"http:\/\/www.savefranklincanyon.com\/\" target=\"_blank\">Save Franklin Canyon<\/a> group, fought the developer&#8217;s attempts to close public access to the trail. They garnered petition signatures and did a great job of alerting the trail using public about what was at stake.<\/p>\n<p>The Mountains Recreation Conservation Authority joined the plaintiffs in the suite, and brought in additional legal resources.<\/p>\n<p>There were enough legacy hikers&#8211;people who could testify and verify that they had been using the trail since before 1972&#8211;to legally establish grounds for a prescriptive easement. \u00a0Judge Palazuelos, who\u00a0presided over the case,\u00a0\u00a0personally toured the trail at the request of the plaintiffs.<\/p>\n<p>On Tuesday, October 16, 2012, the Court made a tentative ruling in favor of the plaintiffs. The defendant, Coldwater Development LLC, have been ordered to remove all equipment and fences from the trail.
